Welcome to Buja Fasta. These Terms and Conditions (“Terms”) govern your access to and use of the Buja Fasta mobile application and website (collectively, the “Platform”). By creating an account or using the Platform, you agree to these Terms.
IMPORTANT NOTICE:
Buja Fasta is a simple marketplace platform that connects buyers and sellers. Buja Fasta does not own, sell, purchase, store, or deliver products, and is not a financial institution. All transactions and agreements are made directly between buyers and sellers.
1. Acceptance of Terms
By accessing or using Buja Fasta, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform. These Terms apply to all users, visitors, buyers, and sellers.
2. Eligibility and User Accounts
- You must be at least 18 years old to use Buja Fasta.
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use or security breach.
3. User Responsibilities
You agree to use the Platform only for lawful purposes. You must not violate any applicable laws, regulations, or third-party rights. You are solely responsible for your interactions with other users.
4. Seller Responsibilities
If you list items for sale on Buja Fasta, you confirm that:
- You have the legal right to sell the item.
- The item is accurately described.
- You are responsible for fulfilling orders and coordinating delivery with buyers.
- You will not list illegal, prohibited, or counterfeit items.
5. Product Listings and Accuracy
Buja Fasta does not verify product listings. Sellers are solely responsible for the accuracy of their listings. We reserve the right to remove any listing that violates these Terms or applicable laws.
6. Messaging and Communication
In-app messaging is provided for transaction-related communication only. You may not use it for spam, harassment, fraud, hate speech, or redirecting users for unsafe purposes. Messages may be reviewed for safety and compliance.
7. Payments and Transactions
Buja Fasta does not provide banking, wallet, escrow, or financial services.
- Payments are handled directly between buyers and sellers.
- Payment methods (such as cash or external mobile payment services) are agreed upon outside the Platform.
- Buja Fasta does not store, hold, manage, or process user funds.
Users are responsible for confirming payment before completing a transaction.
8. Fees
Buja Fasta may charge optional service fees (such as promotional features). Any fees will be clearly disclosed before use. Users are responsible for any applicable taxes related to their transactions.
9. Prohibited Activities
You must not:
- Post false or misleading listings.
- Sell illegal, stolen, or counterfeit items.
- Harass, threaten, or abuse other users.
- Circumvent Platform rules or fees.
- Upload malicious software.
- Collect user data without consent.
10. Content Moderation and Account Suspension
We may remove content or suspend accounts that violate these Terms, our policies, or the law. Suspension or termination may occur without prior notice if required for safety or legal reasons.
11. Intellectual Property
All Buja Fasta branding, logos, and Platform design are our intellectual property. By posting content, you grant Buja Fasta a non-exclusive, worldwide, royalty-free license to display and promote that content on the Platform.
12. Limitation of Liability
To the maximum extent permitted by law, Buja Fasta is not liable for losses, damages, disputes, or claims arising from transactions or interactions between users.
13. Disclaimer of Warranties
The Platform is provided “AS IS” and “AS AVAILABLE.” We make no warranties regarding availability, accuracy, or reliability of the Platform or user listings.
14. Account Termination
You may request account deletion at any time. We may suspend or terminate accounts for violations of these Terms. Upon termination, your right to use the Platform will immediately cease.
15. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after changes means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of the Republic of Burundi. Any disputes shall be resolved in the courts of Burundi.
